Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Bosvita products (the “goods”) and website (the "digital platform") operated by Bosvita Pty Ltd ACN 692 276 305 ("us", "we", or "our").

Your access to and use of the goods and digital platform is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the goods and digital platform.

By accessing or using the goods and digital platform, you agree to be bound by these Terms. If you disagree with any parts of the terms and conditions, you can proceed at your own discretion acknowledging that Bosvita is not liable from here forward.

We may update these Terms periodically. Please review them whenever you visit the Site to ensure you are aware of any changes. By continuing to use the Site after updates are posted, you agree to the revised Terms.

1. Introduction

Bosvita is a skincare business offering goods such as face balms, body balms, deodorants, makeup removers, and more. Our digital platform includes interactive features like the Bosvita Points System, referral program, leaderboard, subscriptions, and Vitality Tracker. Both goods and digital platforms are governed by these Terms.

2. Communications

By creating an account on our digital platform you agree to receive newsletters, marketing or promotional materials, transactional emails (e.g., order confirmations, referral notifications, subscription updates), and other communications from us. You may opt out of marketing communications by following the unsubscribe link or instructions in any email we send, but transactional emails are required for account and order management.

3. Purchases

If you wish to purchase any goods or service made available through the digital platform ("Purchase"), including one-time purchases or subscriptions, you may be asked to supply information such as your credit card number, expiration date, billing address, and shipping information.

You represent and warrant that: (i) you have the legal right to use any payment method(s) in connection with any Purchase; and (ii) the information you supply is true, correct, and complete.

We use third-party services (e.g., Stripe) to facilitate payment and complete Purchases. By submitting your information, you grant us the right to share it with these third parties, subject to our Privacy Policy.

You may redeem Bosvita Points for discounts or rewards on Purchases, subject to the Points System terms below. Points have no cash value and cannot be exchanged for cash.

We reserve the right to refuse or cancel your order at any time due to goods and digital platform availability, errors in description or price, suspected fraud, unauthorized transactions, or other reasons.

4. Availability, Errors, and Inaccuracies

We are continuely updating goods and service offerings on all digital platforms including social media. Information on all digital platforms including social media may contain errors or inaccuracies, and goods or services may be mispriced, described inaccurately, or unavailable. We reserve the right to change or update information and correct errors, inaccuracies, or omissions at any time without prior notice.

5. Contests, Sweepstakes, and Promotions

Any contests, sweepstakes, or promotions (collectively, "Promotions") made available through all digital platforms and social media, including the Bosvita Points System or referral program, may be governed by separate rules, and / or terms and conditions. If you participate in any Promotions, please review the applicable rules and / or terms and conditions, and our Privacy Policy. If Promotion rules conflict with these Terms, the Promotion rules will apply and be overwritten. We may offer competitions or promotions through digital platforms including social media for a limited time, such activities will be governed by separate terms and conditions that will be made available.

6. Accounts

When you create an account, you guarantee that you are above the age of 18 and that the information you provide is accurate, complete, and current. Inaccurate, incomplete, or obsolete information may result in immediate account termination.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device. You accept responsibility for all activities under your account or password, whether with our digital platform or third-party services. Notify us immediately at admin@bosvita.com.au of any security breach or unauthorized use.

Usernames must not infringe on others’ rights, be offensive, or violate laws. You may participate in the Bosvita Points System, referral program, and leaderboard, subject to their respective terms below.

We are not liable for the mistreatment of your personal information outside of our scope pertaining to fraudulent behaviour.

7. Points System and Rewards

The Bosvita Points System allows you to earn points through actions such as (but not subject to): purchases, sharing posts on social media platforms, the promotion of Bosvita on (i) your personal social media platform, etc. Points are awarded after moderation for reviews and are subject to our discretion.

Points can be redeemed for discounts, exclusive products, or other rewards on the "Spend Big Points" page. Points have no cash value and cannot be transferred.

We reserve the right to modify, suspend, or terminate the Points System at any time, and points may be forfeited upon account termination or program changes.

8. Referral Program

Our referral program allows you to earn points per successful signup by sharing your unique referral code, up to a maximum of 10 referrals per account. Referrals must be new users who sign up using your code. Self-referrals or fraudulent referrals are prohibited and may result in point forfeiture or account termination.

We reserve the right to modify or terminate the referral program, and points earned through referrals may be revoked if the program is abused.

9. Leaderboard

The Bosvita Leaderboard ranks users based on points earned. Participation is optional, and you may opt in by selecting a public username on the Leaderboard page or account settings. Only your username, points, and rank are publicly displayed. If you choose to display personal information in your username we are not liable for the misuse of this information.

You may opt out at any time via your account settings, removing your information from the leaderboard. We reserve the right to disqualify participants for fraudulent activity or inappropriate usernames.

10. Subscriptions

Subscriptions provide recurring delivery of products on a monthly, bimonthly, or quarterly schedule. You may modify or cancel your subscription at any time via the Subscriptions page, subject to clause 16. (Returns and Refunds).

Subscription payments are processed automatically using your provided payment method. Failed payments may result in suspension or cancellation of your subscription. Refunds for subscriptions follow our Returns and Refunds policy below.

11. Vitality Tracker

The Vitality Tracker measures collective user engagement to trigger community uplift initiatives (e.g., donations) when reaching 500 points. Participation is automatic through website activities like purchases. Initiatives are announced on our digital platforms including social media.

We reserve the right to modify or terminate the Vitality Tracker, and participation does not guarantee specific outcomes or benefits.

12. User-Generated Content and Reviews

Users may submit reviews, ratings, and other content ("User-Generated Content") through our digital platform. By submitting User-Generated Content, you grant Bosvita a non-exclusive, royalty-free, perpetual license to use, display, modify, and reproduce such content for promotional and marketing purposes.

All User-Generated Content is subject to moderation and approval by Bosvita. We reserve the right to approve, reject, edit, or remove any review or content at our sole discretion for any reason, including but not limited to: content that is inappropriate, offensive, fraudulent, misleading, violates intellectual property rights, does not comply with our community guidelines, or is otherwise deemed unsuitable by Bosvita.

Reviews must be honest, authentic, and based on genuine product experience. You may only submit up to 5 reviews per account. Fraudulent reviews, spam, or content submitted in exchange for compensation (other than our Points System) are strictly prohibited and may result in removal of content, forfeiture of points, and account termination.

Bosvita retains final authority over all review approvals and content moderation decisions. We are not obligated to provide reasons for rejection or removal of User-Generated Content.

13. Intellectual Property

The digital platform and its original content, features, and functionality are the exclusive property of Bosvita and its licensors. The Service is protected by copyright, trademark, and other laws of Australia and foreign countries. Our trademarks and trade dress may not be used without prior written consent.

14. Product Use and Disclaimers

Our products are made with natural ingredients, including grass-fed tallow and organic botanicals. Read ingredients and directions before use, perform a patch test before use to check for allergies or sensitivities. Store products in a cool, dry place, as advised in our FAQ.

Our products are for cosmetic use only and are not intended to diagnose, treat, cure, or prevent any disease or health concern. Consult a healthcare professional for medical concerns. We make no warranties regarding efficacy for specific skin types, and use is at your own risk.

Organic* ingredients are deemed organic based on 3rd party manufacturers and wholesalers specifications of the ingredients contained within the goods provided by Bosvita. We are not liable for any discrepancies or misinformation provided by these manufacturers and wholesalers.

15. Shipping and Delivery

We offer free standard shipping on orders over $120, with delivery typically within 3–7 days in Australia. Subscription orders follow your chosen schedule (monthly, bimonthly, or quarterly) Shipping times are estimates, and we are not liable for delays due to carriers or unforeseen circumstances.

16. Returns and Refunds

We accept returns of unopened products within 30 days of purchase for a full refund, minus shipping costs. Opened products may be eligible for exchange if defective. We have the right to determine what is refundable. Contact us at admin@bosvita.com.au for return instructions.

Subscription cancellations take effect at the end of the current billing cycle, with no further charges. Refunds for subscriptions are not offered unless the product is defective or unopened. Refunds are processed to the original payment method within 7–10 business days of receiving the returned item.

17. Links to Other Websites

Our digital platform may link to third-party websites or services (e.g., social media platforms) not owned or controlled by Bosvita. We are not responsible for their content, privacy policies, or practices. Read the terms and privacy policies of any third-party websites you visit.

18. Termination

We may terminate or suspend your account and access to the digital platform without prior notice for reasons including, but not limited to, breach of these Terms. Upon termination, any accumulated points, referral benefits, or leaderboard rankings may be forfeited.

You may terminate your account by discontinuing use of the Service or contacting us to delete your account.

19. Indemnification

You agree to defend, indemnify, and hold harmless Bosvita, its licensees, licensors, employees, contractors, agents, officers, and directors from any claims, damages, losses, liabilities, costs, or expenses (including attorney’s fees) arising from your use of the goods and digital platform including social media or breach of these Terms.

By using the service, you are agreeing to take responsibility if your actions cause any legal trouble, financial loss, or damage for the company (Bosvita) or the people connected to it.

20. Limitation of Liability

Bosvita, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, resulting from your use of the goods and digital platform, third-party conduct, or unauthorized access to your content, whether based on warranty, contract, tort, or other legal theory.

21. Disclaimer

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, secure, or error-free operation of the goods and digital platform.

22. Governing Law

These Terms shall be governed by the laws of Australia, without regard to its conflict of law provisions. Our failure to enforce any right or provision will not constitute a waiver. If any provision is invalid, the remaining provisions remain in effect.

23. Changes

We may modify or replace these Terms at our discretion. Material changes may be communicated via email or website notice at least 30 days before taking effect. Continued use of the goods and digital platform after revisions constitutes acceptance of the new terms.
