Terms and Conditions

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Bosvita website (the "Service") operated by Bosvita ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Introduction

Bosvita is an all-natural skincare business offering products such as face moisturizers, body balms, shampoos, soaps, deodorants, makeup removers, and more. Our Service includes interactive features like the Bosvita Points System, referral program, leaderboard, subscriptions, and Vitality Tracker, which are governed by these Terms.

2. Communications

By creating an account on our Service, you agree to receive newsletters, marketing or promotional materials, transactional emails (e.g., order confirmations, referral notifications, subscription updates), and other communications from us. You may opt out of marketing communications by following the unsubscribe link or instructions in any email we send, but transactional emails are required for account and order management.

3. Purchases

If you wish to purchase any product or service made available through the Service ("Purchase"), including one-time purchases or subscriptions, you may be asked to supply information such as your credit card number, expiration date, billing address, and shipping information.

You represent and warrant that: (i) you have the legal right to use any payment method(s) in connection with any Purchase; and (ii) the information you supply is true, correct, and complete.

We use third-party services (e.g., Stripe) to facilitate payment and complete Purchases. By submitting your information, you grant us the right to share it with these third parties, subject to our Privacy Policy.

You may redeem Bosvita Points for discounts or rewards on Purchases, subject to the Points System terms below. Points have no cash value and cannot be exchanged for cash.

We reserve the right to refuse or cancel your order at any time due to product/service availability, errors in description or price, suspected fraud, unauthorized transactions, or other reasons.

4. Availability, Errors, and Inaccuracies

We are constantly updating product and service offerings on the Service. Information on the Service may contain errors or inaccuracies, and products or services may be mispriced, described inaccurately, or unavailable. We reserve the right to change or update information and correct errors, inaccuracies, or omissions at any time without prior notice.

5. Contests, Sweepstakes, and Promotions

Any contests, sweepstakes, or promotions (collectively, "Promotions") made available through the Service, including the Bosvita Points System or referral program, may be governed by separate rules. If you participate in any Promotions, please review the applicable rules and our Privacy Policy. If Promotion rules conflict with these Terms, the Promotion rules will apply.

6. Accounts

When you create an account, you guarantee that you are above the age of 18 and that the information you provide is accurate, complete, and current. Inaccurate, incomplete, or obsolete information may result in immediate account termination.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device. You accept responsibility for all activities under your account or password, whether with our Service or third-party services. Notify us immediately at bosvitacare@gmail.com of any security breach or unauthorized use.

Usernames must not infringe on others’ rights, be offensive, or violate laws. You may participate in the Bosvita Points System, referral program, and leaderboard, subject to their respective terms below.

7. Points System and Rewards

The Bosvita Points System allows you to earn points through actions like purchases (100 points per face/body product), reviews (10 for written, 30 for photo, 100 for video), and referrals (25 per successful signup). Points are awarded after moderation for reviews and are subject to our discretion.

Points can be redeemed for discounts, exclusive products, or other rewards on the "Spend Big Points" page. Points have no cash value, cannot be transferred, and expire after 12 months of account inactivity.

We reserve the right to modify, suspend, or terminate the Points System at any time, and points may be forfeited upon account termination or program changes.

8. Referral Program

Our referral program allows you to earn 25 points per successful signup by sharing your unique referral code, up to a maximum of 10 referrals per account. Referrals must be new users who sign up using your code. Self-referrals or fraudulent referrals are prohibited and may result in point forfeiture or account termination.

We reserve the right to modify or terminate the referral program, and points earned through referrals may be revoked if the program is abused.

9. Leaderboard

The Bosvita Leaderboard ranks users based on points earned. Participation is optional, and you may opt in by selecting a public username on the Leaderboard page or account settings. Only your username, points, and rank are publicly displayed.

You may opt out at any time via your account settings, removing your information from the leaderboard. We reserve the right to disqualify participants for fraudulent activity or inappropriate usernames.

10. Subscriptions

Subscriptions provide recurring delivery of products on a monthly, bimonthly, or quarterly schedule. You may modify or cancel your subscription at any time via the Subscriptions page, subject to our cancellation policy.

Subscription payments are processed automatically using your provided payment method. Failed payments may result in suspension or cancellation of your subscription. Refunds for subscriptions follow our Returns and Refunds policy below.

11. Vitality Tracker

The Vitality Tracker measures collective user engagement to trigger community uplift initiatives (e.g., donations) when reaching 500 points. Participation is automatic through website activities like purchases. Initiatives are announced on our Instagram and Facebook pages.

We reserve the right to modify or terminate the Vitality Tracker, and participation does not guarantee specific outcomes or benefits.

12. Intellectual Property

The Service and its original content, features, and functionality are the exclusive property of Bosvita and its licensors, protected by copyright, trademark, and other laws of Australia and foreign countries. User-generated content (e.g., reviews submitted for points) grants Bosvita a non-exclusive, royalty-free license to use, display, and reproduce for promotional purposes.

13. Product Use and Disclaimers

Our products are made with natural ingredients, including grass-fed tallow and organic botanicals. Perform a patch test before use to check for allergies or sensitivities. Store products in a cool, dry place, as advised in our FAQ.

Our products are for cosmetic use only and are not intended to diagnose, treat, cure, or prevent any disease. Consult a healthcare professional for medical concerns. We make no warranties regarding efficacy for specific skin types, and use is at your own risk.

14. Shipping and Delivery

We offer free standard shipping on orders over $120, with delivery typically within 3–7 days in Australia. International shipping incurs additional fees. Subscription orders follow your chosen schedule (monthly, bimonthly, or quarterly). Shipping times are estimates, and we are not liable for delays due to carriers or unforeseen circumstances.

15. Returns and Refunds

We accept returns of unopened products within 30 days of purchase for a full refund, minus shipping costs. Opened products may be eligible for exchange if defective. Contact us at bosvitacare@gmail.com for return instructions.

Subscription cancellations take effect at the end of the current billing cycle, with no further charges. Refunds for subscriptions are not offered unless the product is defective or unopened. Refunds are processed to the original payment method within 7–10 business days of receiving the returned item.

16. Links to Other Websites

Our Service may link to third-party websites or services (e.g., social media platforms) not owned or controlled by Bosvita. We are not responsible for their content, privacy policies, or practices. Read the terms and privacy policies of any third-party websites you visit.

17. Termination

We may terminate or suspend your account and access to the Service without prior notice for reasons including, but not limited to, breach of these Terms. Upon termination, any accumulated points, referral benefits, or leaderboard rankings may be forfeited.

You may terminate your account by discontinuing use of the Service or contacting us to delete your account.

18. Indemnification

You agree to defend, indemnify, and hold harmless Bosvita, its licensees, licensors, employees, contractors, agents, officers, and directors from any claims, damages, losses, liabilities, costs, or expenses (including attorney’s fees) arising from your use of the Service or breach of these Terms.

19. Limitation of Liability

Bosvita, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, resulting from your use of the Service, third-party conduct, or unauthorized access to your content, whether based on warranty, contract, tort, or other legal theory.

20. Disclaimer

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, secure, or error-free operation of the Service.

21. Governing Law

These Terms shall be governed by the laws of Australia, without regard to its conflict of law provisions. Our failure to enforce any right or provision will not constitute a waiver. If any provision is invalid, the remaining provisions remain in effect.

22. Changes

We may modify or replace these Terms at our discretion. Material changes will be communicated via email or website notice at least 30 days before taking effect. Continued use of the Service after revisions constitutes acceptance of the new terms.
